Guarantee

All products offered in our shop are guaranteed against breakage or damage occurring in the process of transport or obvious manufacturing defects and, where appropriate, by that granted by each manufacturer or by the legislation in force.

We make a special effort to ensure that our products have the backing of renowned manufacturers and a high level of quality as well as a careful packaging process.

The guarantee is effective through the refund of the amount paid or the replacement of the model, although the latter is not always possible as it depends on the availability of units at any given time or the type of defect in the model.

Modelmotor does not guarantee in all cases the replacement of the model for another model of the same or similar characteristics, but always guarantees the refund of the amount paid. Additional conditions Modelmotor reserves the right to process orders placed through its website. Having placed an order does not imply any obligation on the part of Modelmotor to accept it, in part or in whole. Depending on the customer's history, Modelmotor may cancel the customer's account and the order placed unilaterally. The prices indicated are valid except in the case of error or omission and do not imply any contractual obligation on the part of Modelmotor. In the event that there is an upward price variation, due to an error, the customer will be informed before placing the order for approval. The photographs of the models shown on our website as well as the information shown in the file of each article are merely informative and do not imply any contractual obligation on the part of Modelmotor. If you detect any error, please inform us so that we can correct it. 

Return

Returns If for any reason you are not satisfied with the product purchased online, you have a period of 14 days from the date of delivery of the product to return it.
In this case, shipping and collection costs will be taken care of by the customer.

Before making the return, the customer must contact our sales department info@modelmotor.es within the period indicated by email, telephone or fax where the return process will be indicated.

Any return without this prior communication will not be accepted.

To accept the return, both the product and its packaging must be in perfect condition, without scratches or broken or damaged packaging and including all the documentation that accompanies the product as well as its accessories. The customer must pack the product correctly to ensure that it is transported undamaged. Once received and verified by our staff that the product is in the same condition in which it was sent, we will proceed to refund the amount as previously agreed with the customer.

TERMS AND CONDITIONS OF DISTANCE SELLING

These terms and conditions govern the distance selling service operated by Union Hidraulica S.L.

• 1. CONTRACTING PROCEDURE
  
  1.1. Contracting Parties: Modelmotor makes various products available to Users through the website modelmotor.es and via telephone at +34 961509000. Purchases are finalized by filling out the required order forms throughout the checkout process and explicitly accepting these Terms and Conditions. Submitting the order form (by clicking the final purchase button) completes the order process and constitutes full acceptance of Modelmotor's commercial offer and applicable conditions. Modelmotor retains an electronic copy of the transaction records.
  
  1.2. Order Confirmation: Upon completion of the purchase process, Modelmotor will provide the User with an order confirmation via email detailing all applicable terms and product details. If a transaction fails for any reason, Modelmotor will notify the User. To the extent permitted by law, Modelmotor bears no liability regarding failed transactions.
  
  
• 2. PAYMENT METHODS
  
  2.1. The User may select their preferred payment method during checkout from those enabled by Modelmotor: Credit/Debit Card, PayPal, Bank Transfer, or Cash on Delivery (COD) (only in Spain available).
  
  
• 3. SHIPPING AND DELIVERY
  
  3.1. Once the order process is complete, products will be shipped to the delivery address specified by the User. Shipments are handled via DHL or postal services (Correos).
  
  3.2. Modelmotor will hand over the parcel to the carrier within a maximum of three (3) business days following order confirmation. Delivery times depend on the destination and courier operations. The User will receive an email containing shipment tracking details. Estimated delivery times from order dispatch are as follows: Deliveries to Germany & EU countries: 3–7 business days. International deliveries (Non-EU): 7–20 business days (subject to customs handling). The User acknowledges that these delivery times are estimates and delays outside the control of Modelmotor or the shipping company may occur.
  
  3.3. Uncollected Orders: The agreement shall be deemed canceled by the User if delivery cannot be completed after two (2) attempts by DHL and five (5) days have passed since the second attempt, or if a parcel held at the post office is not collected within 7 calendar days after notification.
  
  3.4. Shipping Costs: Unless explicitly stated otherwise, handling, packaging, shipping costs, and applicable taxes (such as VAT) are the responsibility of the User and are payable at checkout alongside the product price.
  
  3.5. Cash on Delivery Policy: If a customer fails to accept or pay for an order shipped under "Cash on Delivery," this payment method will be disabled for future orders placed by that customer.
  
  
• 4. RIGHT OF WITHDRAWAL & RETURNS
  
  4.1. The User has the right to withdraw from the contract within 14 calendar days from the date of receipt of the item without stating any reason, subject to the following requirements: a) Notify Modelmotor of the intent to withdraw via email at info@modelmotor.es. b) The product must be returned in its original packaging, undamaged, and complete with all accessories.
  
  4.2. Refunds will be processed within fourteen (14) days of Modelmotor receiving and verifying the returned item, using bank transfer or the original payment method.
  
  
• 5. PERSONAL DATA
  
  5.1. The Customer confirms that all information provided during the checkout process is accurate and authorizes Modelmotor to verify such data in accordance with applicable data protection laws (GDPR).
  
  
• 6. APPLICABLE LAW
  
  6.1. The relationship between Modelmotor and the User shall be governed by and construed in accordance with Spanish law.
